Widow Pension

  1. Short title and commencement-(1)This scheme may be called the West Bengal Widow Pension Scheme, 2010. (2) It shall come into force on such date, as the State Government may, by notification in the Official Gazette, appoint.
  2. Eligibility for the Scheme-
    1. This scheme shall apply to widow girl/woman, if the widow girl/woman satisfies the following conditions: -
      1. She is a citizen of India and resident of the state namely West Bengal.
      2. Her family income, if any, does not exceed Rs. 1000.00(one thousand) per month.
      3. She is not being maintained by anyone of her relations.
      4. She has been a resident of the state namely West Bengal for not less than ten years on the date of making application for Widow Pension
    2. The State Government, however, reserves the right to relax the condition regarding residence mentioned in paragraph (d) of sub-clause (1) of clause 2, where the condition causes undue hardship.

      Note 1.- Professional beggars and mendicants shall not be eligible for pension under this scheme. But persons who are not actually beggars by profession but receive occasional assistance from someone shall be entitled to pension, if otherwise eligible.

      Note 2.- The application who is a recipient of “Disability Pension”, “Old Age Pension”, “Farmers’ Pension” or pension under “Family Pension Scheme” of the State Government or of the Central Government or of other concerns, shall not be entitled to Widow Pension.

    3. The amount of the monthly Widow Pension shall be determined by the Department of Women and Child Development and Social Welfare of the State Government in consultation with the Finance Department from time to time
  3. Definition-In this scheme, unless there is anything repugnant in the subject or context-
    1. “Application” means an application for widow Pension;
    2. “Applicant” means the widow girl/woman who has applied for Widow Pension;
    3. “Form” means form as prescribed by the State Government in this behalf;
    4. “Pension” means Widow Pension under this scheme;
    5. “Pensioner” means the applicant who has been allotted Widow Pension under this scheme;
    6. “Secretary” means the Secretary or the Principal Secretary to the Government of West Bengal, Department of Women & Child Development and Social Welfare;
    7. “State Government” means the State Government in the Department of Women and Child Development and Social Welfare;
    8. “State” means the State of West Bengal;
    9. “Relation” means and includes-
      1. Son / daughter;
      2. Brother;
      3. Parents.
  4. Method of Applying for Widow Pension-
    1. Application Form(Form-P) for Pension may be obtained free of cost from following offices namely:
      1. Office of the Block Development Officer or the Executive Officer of the concerned Panchayat Samity in case of the applicant resides in the rural areas under the said Panchayat Samity
      2. Office of the Sub-Divisional Officer in case of the applicant resides in Municipal / Notified areas outside the areas of Kolkata Municipal Corporation, and
      3. Office of the Controller of Vagrancy, West Bengal situated at Purta Bhawan, Bidhan Nagar, Kolkata-700091, in case of the applicant resides within the areas under Kolkata Municipal Corporation
    2. Application Form for Pension shall be addressed to:-
      1. The District Magistrate of the concerned District and shall be submitted to the Block Development Officer or the Executive Officer of the Panchayat Samity in case of the applicant residing in the rural areas under a Panchayat Samity;
      2. The District magistrate of the concerned District and Shall be submitted to the Sub-Divisional Officer in case of the applicant residing in Municipal / Notified areas outside the areas of Kolkata Municipal Corporation.
      3. The Controller of Vagrancy, West Bengal and shall be submitted to the Controller Vagrancy West Bengal in case of the applicant residing within the areas under Kolkata Municipal Corporation.

    2. It shall come into force on such date, as the State Government may, by notification in the Official Gazette, appoint.
  2. Application of the scheme –
    1. This scheme shall apply to a disabled person entitled to receive Pension under this scheme, if the disabled person satisfies the following the conditions: -
      1. The Disabled person is a citizen of India and resident of the state namely West Bengal;
      2. The Disabled person’s family income, if any, does not exceed Rs. 1000.00 (One thousand) per month;
      3. The Disabled person is declared unsuitable for physical work by the respective Medical officer;
      4. The Disabled person has been a resident of the state namely West Bengal for not less than 10 Years on the date of making application for Pension.

           Provided that in case of the disabled person whose age is below 10 years, the period of residence shall be limited to the period covered by the date of birth and date of submission of the application.
    2. The State Government, however, reserves the right to relax the condition regarding residence mentioned in paragraph (d) of sub-clause (i) of clause 2, where the condition causes undue hardship.

      Note 2.- The Disabled person who is a recipient of “Widow Pension”, “Old Age Pension”, “Farmers’ Pension” or pension under “Family Pension Scheme” of the State Government / the Central Government / other concerns, shall not be entitled to the Pension under this scheme.

    3. The amount of the Pension shall be determined by the Department of Women and child Development and Social Welfare of the State Government in consultation with the Finance Department from time to time.
  3. Definition- In this scheme, unless there is anything repugnant in the subject or context –
    1. “Application” means an application for Pension;
    2. “Form” means form as prescribed by the State Government in this behalf;
    3. “District Officer” means the District Magistrate or the Deputy Commissioner of the District;
    4. “The Disabled person” means and includes both male or female person who is deaf and dumb or blind or orthopedically handicapped or mentally retarded and permanently incapacitated to earn a living and declared as such by the medical officer as the case may be, and satisfies the conditions provided in sub-clauses (i) and (2) of clauses 2 of the scheme;
    5. “Medical Officer” means a Medical Officer in charge of Public Health Centre, in case of rural areas, in case of municipal areas (not fallen under Kolkata Municipal Corporation)/ notified areas, a Medical Officer in charge of the sub-divisional hospital. They shall issue disability certificate. In case of the areas fallen under Kolkata Municipal Corporation, a Medical Officer appointed by the Controller of Vagrancy, West Bengal, for this purpose shall issue necessary certificate. No pension will be admissible to a disabled person with degree of disability of less than 40 per cent;
    6. Pension means Disability Pension under this scheme;
    7. “Pensioner” means the Disabled person who has been allotted Disability Pension under this scheme;
    8. Secretary to the Government of West Bengal, Department of Women & Child Development and Social Welfare;
    9. “State Government” means the State Government in the Department of Women and Child Development and Social Welfare;
    10. “State” means the State of West Bengal;

    1. Application Form(Form-P) for Pension may be obtained free of cost from following offices namely:

    2. It shall come into force on such date, as the State Government may, by notification in the Official Gazette, appoint.
  2. Eligibility for the Pension –
    1. A person who is entitled to receive pension under this scheme shall satisfy the following conditions: -
      1. the person has attained the age of sixty years and is a resident of the State: Provided that in case of physically and mentally handicapped person, the age limit shall be fifty five years;
      2. the person has no relation who can maintain him/her;
      3. the income of the person does not exceed Rs. 1000.00 (rupees one thousand) per month;
      4. the person applying for Old Age Pension is not a recipient of any other Government pension; and
      5. the person has been residing in the State for not less than ten years on the date of making the application:

           Provided that the State Government may relax the condition regarding residence where such condition causes undue hardship.

        Note 1. - Professional beggars and mendicants of urban areas (cities and towns) and persons receiving “Disability Pension”, “Widow Pension”, “Farmers’ Pension”, “Political Sufferers”, or any other pension of any State Government or the Central Government shall not be eligible for pension under this scheme. But persons who are not actually beggars by profession but receive occasional assistance from someone shall be entitled to pension, if otherwise eligible.

        Note 2. - – When only the year of birth is known, 1st July of that year or when the month is only known, 16th day of the month is to be taken as the date of birth.

    2. The amount of the monthly Old Age Pension shall be determined by the Department of Women and Child Development and Social Welfare of the State Government in consultation with the Finance Department from time to time.
  3. Definition – In this scheme, unless there is anything repugnant in the subject or context-
    1. “Application” means an application for Old Age Pension;
    2. “Applicant” means the person who has applied for Old Age Pension;
    3. “Form” means form as prescribed by the State Government in this behalf;
    4. “The person” means who satisfy the conditions provided in sub clause (1) of clause 2 of the scheme and includes both male and female persons;
    5. “Pension” means Old Age Pension under this scheme;
    6. “Pensioner” means the applicant who has been allotted Old Age Pension under this scheme;
    7. “Secretary” means and includes the Secretary or the Principal Secretary to the Government of West Bengal, Department of Women & Child Development and Social Welfare;
    8. “State Government” means the State Government in the Department of Women and Child Development and Social Welfare;
    9. “State” means the State of West Bengal;
    10. “relation” means and includes-
      1. son, son’s son;
      2. husband, wife;
      3. unmarried daughter;
      4. parents

    1. Pension Information Form (Form-P) for Pension may be obtained free of cost from following offices namely:
      1. Office of the Block Development Officer or the Executive Officer of the concerned Panchayat Samity in case of the applicant resides in the rural areas under the said Panchayat Samity;
      2. Office of the Sub-Divisional Officer in case of the applicant resides in Municipal / Notified areas outside the areas of Kolkata Municipal Corporation, and
      3. Office of the Controller of Vagrancy, West Bengal situated at Purta Bhawan, Bidhan Nagar, Kolkata-700091, in case of the applicant resides within the areas under Kolkata Municipal Corporation.
